please be aware that by purchasing of any products branded BV Milano supplied by the ILC’S website – www.bvmilano.com ("Products") You have accepted ILC’s Privacy Policy, so if for any reasons You have any doubts about the way we collect and manage Your information, please go back to ILC's Privacy Policy in order to find full information about how ILC S.r.l. collects and uses personal information from users of the ILC’s website.

Please remember that Your browsing our website will be governed by the General Terms and Conditions of Use, and that the following provisions entitled Conditions of Sale prevail over General Terms and Conditions of Use when you purchase any of our Products BV Milano, via the ILC’S website.

We kindly ask You to read these terms and conditions carefully before ordering any Products from our website. You should understand that by ordering any Products, you agree to be bound by these Conditions of Sale (hereinafter also "Sales Terms").

ILC S.r.l. may revise these Sales Terms from time to time. Any changes to the Sales Terms will apply to orders placed on after the effective date stated in these Sales Terms or elsewhere on the website www.bvmilano.com, You are therefore advised to check this page from time to time to take notice of any changes, as they are binding on You.

BEFORE PLACING AN ORDER FOR PRODUCTS, YOU MUST READ AND AGREE TO BE BOUND BY THESE SALES TERMS AND PRIVACY POLICY PROVISIONS. IF YOU FIND YOURSELF UNABLE TO AGREE TO THESE SALES TERMS AND PRIVACY POLICY PROVISIONS YOU MAY NOT PROCEED TO PURCHASE ANY PRODUCTS LISTED ON THE ILC’S WEBSITE.

1 - YOUR ACCOUNT

If You create an account (personal user identification or username) on ILC’s website – www.bvmilano.com - You are fully responsible for maintaining the confidentiality of Your username and password and for restricting access to Your password, and You hereby agree to accept responsibility for all activities that occurs under Your account, unless those activities or purchases are carried out by an unauthorised third party who has gained access to Your account other than by reason of Your clear negligence or carelessness.

It is Your responsibility to use virus checking software on any material downloaded from this Site and to ensure the compatibility of such software with Your equipment. In circumstances where You provide us with information relating to any third parties, You warrant that You have received that third party’s consent in relation to such disclosure and that the third party has been informed of, and agrees to, our Privacy Policy and our Cookies Policy and the uses which we may make of such information.  You will be responsible for any loss or damages we may suffer if You breach this warranty.

2 - OUR BUSINESS POLICY

ILC S.r.l. (the Vendor) offers products for sale on www.bvmilano.com and its e-commerce business services are available exclusively to its end users, i.e. the "Consumers", i.e any individual who is acting for purposes which are outside his or her/his trade, business or profession. If You are not a Consumer, please do not buy any products on ILC’s website.

The Vendor reserves the right not to process orders received from users who are not "Consumers" and any other order which does not comply with the Vendor's business policy. These General Terms and Conditions of Sale exclusively regulate the offer, transmission and acceptance of purchase orders relating to products on www.bvmilano.com, between the Users of www.bvmilano.com and ILC S.r.l.

The General Terms and Conditions of Sale do not regulate the supply of services or the sale of products performed by third parties that are linked to our website by banners or other hypertext links. Before sending orders and purchasing products and services from those third parties, we recommend that You verify the third party's terms and conditions. services provided by third parties or for the execution of e-commerce transactions between the users of www.bvmilano.com and third parties. 

3 - ACCEPTANCE OF PLACING AN ORDER

To be able to buy Products You must:

  • read and accept these Sales Terms;
  • provide all details required in the order form, such as Your name and address, phone number, email address and phone, shipping address if different, payment details and all other information we might need to deliver the product such as an eligible delivery address;
  • be legally capable of entering into binding contracts;
  • be the owner or authorized holder of a valid debit/credit card.

You may purchase online on www.bvmilano.com 24 hours a day, seven days a week. To place an order, simply click on the ADD TO YOUR CART button to place a product, and then follow the directions through the check-out process, to complete Your order. You will be provided with an opportunity to review Your order(s), read and accept these Sales Terms and Returns and Refunds Policy, check the total price of Your order(s) and the information You have provided and correct any input errors before confirming Your order(s).

Please note that unfortunately ILC S.r.l. currently cannot ships all around the world, so we apologise for any order we could be force to refuse because of the shipping address.

Please also note that I.L.C. products are shoes, belts and accessories in different type of leather, so I.L.C will follow all the existing legislation for sales outside the European Community, where required.

4 - ORDER PROCESSING, CONTRACT FORMATION AND EXECUTION

Once you have submitted and confirmed your order(s) using ILC ’s website, ILC S.r.l. will send an email to the email address You provided acknowledging receipt of Your order(s) ("Order Receipt Confirmation") and setting out details of the ordered Product(s). The ORC is driven the delivery process, so if you might discover a difference compared to your order or to your desire, please contact us via email (info@bvmilano.com) within 2 working days so we can stop the order or modify your order

ILC S.r.l. may choose not to accept any order in ILC's sole discretion including, without limitation in the case of pricing errors, unusual orders and orders which ILC suspects are not placed in good faith.

After receiving Your order(s), ILC S.r.l. will check that the relevant Product(s) is (are) in stock. A contract for the sale of Products between You and ILC S.r.l. will only be formed when ILC S.r.l. emails You its confirmation that all, or part of the Product(s), is/are available and has/have been dispatched ("Shipment Confirmation"). Please be aware that a contract is now formed on ILC sending the Shipment Confirmation, whether or not You receive such email.

The contract for the sale of Products will relate only to those Products whose dispatch has been confirmed in the Shipment Confirmation. ILC will not be obliged to supply any other Products which may have been part of Your order until the dispatch of such Products has been confirmed in a separate Shipment Confirmation. In the Order Receipt Confirmation, You will receive a copy of these Sales Terms, however You are encouraged to download, save and/or print a copy of Your Order Receipt Confirmation and these Sales Terms for Your records.

Orders may be modified or cancelled before the delivery process has been initiated by contacting us by phone at +393911749461, Monday to Friday 11:00 AM to 6:00 PM,  or by email at info@bvmilano.com.

Once the delivery process has been initiated and a tracking number has been issued, orders may no longer be modified. However, You have the option of either refusing to accept the delivery, in which case the Products will be returned to ILC S.r.l., or accepting the delivery and then returning the Products to ILC S.r.l. in accordance with Returns and Rufunds

Once You have received your Shipment Confirmation, it will be too late to prevent the Products from being dispatched to you. If you would like to cancel your order after this point, please see Return and Refunds, or send immediately an email to info@bvmilano.com. indicating your order you want to cancel. In this case if it is feasible to stop the delivery we will refund only the value of the products.  

5 - PRICES, SHIPPING AND HANDLING

The price charged for a Product will be the price in effect at the time your order is placed and will be set out in the Order Receipt Confirmation and in your Shipment Confirmation.

In the event of a pricing error, whether on the ILC’s website or in an Order Receipt Confirmation or otherwise, you accept that ILC has the right to correct such error and charge the correct price or cancel the order. If the actual price is more than the amount shown on Your Order Receipt Confirmation, ILC S.r.l. will notify You of the correct price and give You the option of proceeding with the order or cancelling it. Your sole remedy in the event of such pricing error is to cancel Your order.

You acknowledge that even after ILC S.r.l. has sent You a Shipment Confirmation, if the pricing error is obvious and could reasonably have been recognised by You as an error, then ILC S.r.l. will be under no obligation to provide the relevant Product(s) to You at the incorrect (lower) price.

Prices for the Products include VAT and/or other applicable taxes but do not include charges for shipping and handling. Separate charges for shipping and handling (and their related VAT or other taxes) will be clearly displayed on screen prior to the completion of Your order and confirmed in Your Order Receipt Confirmation.

Prices for Products and for shipping and handling are liable to change at any time, but changes will not normally affect orders in respect of which we have already sent You a Shipment Confirmation (save in the case of a manifest pricing error as described above). 

6 - PAYMENTS

Payment for Your order, including all applicable taxes, shipping and other charges, must be made by using one of the procedures indicated on the order form, i.e. You must provide all required billing information to complete Your purchase.  You are therefore committed to submit information accurate and true and You hereby confirm that You have the right to provide and use such payment information. 

Payment shall be made by one of the methods You have selected during the checkout process.

Please note that we accept and process most popular credits and debit cards, PayPal.

In the event ILC S.r.l. does not receive the appropriate authorization from your card or payment service provider, ILC S.r.l. reserves the right to reject your order.

In case of payment by Credit/Debit Card, all details (for example, card number or expiration date) will be sent by encrypted protocol to banks and other authorized financial operators which provide remote electronic payment services, without third parties having any access thereto whatsoever. Such details will not be used by the Vendor except for performing the procedure relevant to your purchase or issuing refunds in the case of returns in compliance with the exercise of Your return right or for reporting cases of fraud to the police.

7 - TAX INFORMATION

We remind You that purchasing on ILC’s website – www.bvmilano.com - is reserved for end consumers so that our prices are always inclusive of VAT or any other applicable tax.

For each order on ILC’s website, ILC S.r.l. issues invoice. The document will be sent as an attachment in the Shipping Confirmation email. Please note that once the order has been confirmed there is no way to modify the details You have entered, and therefore it is not possible to issue a new invoice.

8 - PAYMENT SECUTIRY

On ILC ’ website, every purchase is made with maximum security thanks to the use of PayPal payments platform https://www.paypal.com/uk/webapps/mpp/paypal-safety-and-security which provide its services according with The Payment Card Industry Data Security Standard (PCI DSS), which is a set of industry-mandated requirements for any business that handles, processes, or stores credit cards – regardless of the business's size or location.  

Furthermore, our payment platform is compliant with 3D Secure 2 (3DS2), the new industry standard for customer authentication to meet PSD2’s Strong Customer Authentication (SCA) requirements.

We only use protected connections, as demonstrated by the "https" URL prefix and the lock symbol that appears in the browser's address bar.

To safeguard Your credit card purchases, You will always be asked to enter your CVV code for every order. As an additional safety measure, You may be asked, by your credit card provider, to authorise payment by entering a one-time password, an SMS code, or another authentication method.

Please note that Cardholder Data is managed in the PayPal, using multiple encryption keys with split knowledge and dual control. A data thief would not be able to make use of information stolen from a database without also having the key. This data store cannot be connected to via the internet.

Our Payments department may carry out anti-fraud checks before approving the transaction and for greater protection, they may contact You for further details before confirming the order.

9 - PRODUCT AVAILABILITY

ILC S.r.l. uses all reasonable efforts to ensure the availability of Products You order from ILC’s website www.bvmilano.com. However, Products are made available to purchase on a "first in-first out" basis and are only available whilst stocks last.

10 - PRODUCT INFORMATION

It’s Your own responsibility to ensure that the Products You purchase are compatible for the intended use, so please use the information on the website or ILC S.r.l. customer care when checking compatibility.

ILC S.r.l. makes all reasonable efforts to ensure the best possible match between the product represented in the images on the website and each single shipped product, but since all the products are pieces handcrafted/manufactured  with natural materials it is always possible that there are slight differences between the displayed product and the one delivered to You, especially concerning the colors as actual color You see will depend on Your computer system and device. Regardless this reasonable and unavoidable difference, if the Products You have received do not correspond to the ones You have ordered, or if Your delivery is incomplete or damaged in transportation, please contact ILC S.r.l. for assistance without delay, either via email or by phone.

It might happen that ILC’s website contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, and availability. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice (including after You have submitted your order). 

In the event of a difference between the ILC’s website content and any other website, or any other source of information, the compatibility of Products as shown on the ILC’s website - at the time of purchase - will be seen as the only trustworthy.

11 – PROMOTIONS

From time to time, ILC S.r.l. might offer sweepstakes, contests or other promotions that require You to send material or information about yourself. Please note that sweepstakes, contests or promotions offered via ILC’s website might be, and often are, governed by a separate set of rules that, in addition to describing such sweepstakes, contest or promotion, may have eligibility requirements, such as certain age or geographic area restrictions, terms and conditions governing the use of material You submit, and supplemental disclosures about how Your personal information may be used. It is Your responsibility to read such rules to determine whether or not You want to and are eligible to participate, register and/or enter.

By entering any such sweepstakes, contest or other promotion, You agree to comply with and abide by such rules and the decisions of any sponsor(s) identified therein, which shall be final and binding in all respects.

12 - PROPERTY AND OWNERSHIP OF PRODUCTS

Ownership of the Products will pass to You only when ILC S.r.l. has received full payment in respect of Your order, including taxes, shipping and all other charges. Until then, ILC S.r.l. retains full legal title to the Products.  

The Products will be at Your own risk and responsibility from the time You take physical possession of them.

13 - DELIVERY

In stock products, purchased on www.bvmilano.com are normally delivered (standard delivery) within 7  working days from the order date in Italy, and within 10 working days for all other destinations, provided that Your payment is received before 2pm on the day that the order is placed.

Shipments to some countries of materials protected by the CITES treaty of Washington need specific documentation, whose drawing up could delay shipping standard timing. In such case, we will send You notice within the shipment confirmation mail.

At present we are unable to ship orders to General Deliver and P.O. Boxes.

Deliveries may incur slight delays during holiday periods (generally the full month of August and in December from the 20th  till January the 7th)  and couriers do not deliver on 25/12, 26/12, 01/01 or other national holiday,  and on weekends but products shall, in any case, be delivered within 30 days after shipping confirmation in accordance with the terms foreseen by laws in force.

If for any event ILC S.r.l. cannot deliver your order within the period specified in Your Shipment Confirmation, ILC will notify You as soon as possible and You may choose to cancel Your order, in which case ILC S.r.l. will provide You with a full refund.

If You unreasonably defer delivery or delay the receipt of delivery after ILC has notified You that the carrier has tried to deliver the ordered items to You, or if You have provided ILC with an incorrect delivery address which results in an unsuccessful delivery, the delivery package will be returned to ILC, Your order will be cancelled and a full refund will be issued to You.

Upon delivery, the signature confirmation by a person who is at least 18 years of age is required for all www.bvmilano.com orders. You acknowledge that any person taking delivery of the products at the designated address shall be deemed to have done it with Your authorization.

14 – RETURN AND REFUND

If for any reason You decide not to keep Your online purchase(s), please check carefully our Return and Refund Policy and before returning the item(s), pls contact us at +39 3911740461 or email at info@bvmilano.com to obtain a Returned Merchandise Authorization (RMA) number.

Please note that ILC S.r.l. will accept merchandise for a full refund, provided that item(s) is (are) in its (their) original condition and with all original packaging and enclosures. Please take care to return any certificates that accompanied the item, as neglecting to do so will render You liable for the replacement cost.

Any associated shipping costs will not be subject to refund.

Refunds may only be issued in the same form used for payment.

Merchandise must be returned within 19 days (Europe) and within 22 days (outside of Europe) from date of shipping confirmation, i.e. 14 day after Your receiving the item(s).

We cannot accept returns that have been worn, used, altered or damaged. We reserve the right to refuse return of any merchandise that does not meet the above return requirements according to Our sole discretion.

We recommend shipping returned merchandise via insured parcel post for tracking purposes as we will not assume responsibility for reimbursement or compensation in the event that return packages are lost, stolen, or mishandled.  

All cancellations are carried out accordingly with the Italian and European Consumer Contracts Regulations, i.e. that are regulated by legislative decree No. 21 of February 21st, 2014, implementing directive 2011/83 / EU on consumer rights and amending the previous Consumer Code under legislative decree 6th September 2005, n. 206.

15. CONSUMER WARRANTY (Guarantee)

THIS GUARANTEE GIVES YOU SPECIFIC RIGHTS.

YOU ALSO HAVE OTHER RIGHTS UNDER LAW WHICH MAY VARY FROM COUNTRY TO COUNTRY.

You can find out all information about Your legal rights and remedies by contacting Your local consumer advice service. ILC S.r.l. has a legal duty to supply products that conform to the contract. Nothing in this guarantee will replace or lessen any of Your legal rights or remedies.

Products sold by the ILC’s website include a guarantee for Products which turn out to be faulty or not as described during the periods set out below for various Product types. 

The costumer user is entitled to the guarantee on the conformity of the products and services purchased. The warranty has a duration of 24 months starting from the delivery of the goods and the lack of conformity must be communicated to ILC within 1 month of discovery.

To exercise the warranty right, the Customer must send an e-mail to  ILC srl Co. indicating the order number and the accurate description of the defect (it is recommended to also attach photographic material).

Warranty gives You the right to request a repair or replacement free of charge if the Products turn out to be faulty during this period.  Under this guarantee, ILC S.r.l. can - at its sole discretion - repair Your Product or replace it with a Product of identical or similar characteristics. If ILC S.r.l. chooses to repair Your Product, it may do so with new or refurbished components. If the Product cannot be repaired or replaced within a reasonable time or without inconvenience, You may request a refund or price reduction. Refunds, if authorized, will usually be made using the same method originally used by You to pay for your purchase.

This guarantee is given to the original purchaser of the Product from the ILC's website – www.bvmilano.com and is not transferable, so please retain Your order confirmation/invoice or pass it on to the gift recipient as the original proof of purchase is the warranty. In case original receipt or invoice is not available, a credit card or bank statement showing the relevant transaction will suffice.

The guarantee does not cover  the standard wearing use and tears or damages caused by accident, mishandling and/or  improper use. 

16 - EVENTS OUTSIDE THE CONTROL OF ILC S.R.L.

ILC S.r.l. shall not be held responsible for any delay or failure to perform, if the delay or failure is caused by any act, event, accident or any other happening due to extenuating circumstances i.e. beyond its reasonable control, including but not limited to: 

  • civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;
  • strikes or lock-outs (or other industrial action);
  • national or local states of emergency;
  • interruption or failure of communication or transportation facilities;
  • power or utility outages;
  • non-performance by suppliers or subcontractors (other than by companies related to ILC S.r.l.);
  • earthquake, fire, explosion, storm, flood, subsidence, epidemic or other natural disaster;
  • impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport;
  • the acts, decrees, legislation, regulations or restrictions of any government.

The time for ILC's performance is deemed to be extended for the period that the above continues. 

17 - LIABILITY

ILC warrants to You that all Products purchased from ILC’s website – www.bvmilano.com - is of satisfactory quality and reasonably fit for all the purposes for which such products are commonly supplied.

These Sales Terms set out the full extent of the obligations and liabilities of ILC S.r.l. in respect of Products on sale via ILC’s website with the brand BV Milano. To the extent permitted by applicable law, there are no other warranties, conditions or terms that are binding on ILC S.r.l. other than those set out in these Sales Terms.

NEVERTHELESS, NOTHING IN THESE SALES TERMS AFFECTS ANY OF THE LEGAL RIGHTS OF CONSUMERS DESCENDING FROM EUROPEAN LAWS.

18 - OBLIGATIONS, Severability

These Sales Terms and conditions represent the entire agreement between ILC S.r.l. and You and supersede any prior agreement, understanding or arrangement between the parties, whether oral or in writing.

If any provision of these Sales Terms shall be deemed unlawful, void or for any reason unenforceable by any country or by any ordinary local court, then that provision shall be deemed severable from these Sales Terms and shall be enforced to the fullest extent permitted by applicable law and shall not affecting the validity and enforceability of any of other remaining provisions. 

19 - TRANSFER OF RIGHTS AND OBLIGATIONS

These Sales Terms are binding on You and ILC S.r.l. and on any other legal subject to whom ILC S.r.l. might transfer its rights to.

You may not assign your rights or obligations under these Terms to anyone.

On the Contrary, accordingly with law ILC S.r.l may cede, assign or otherwise transfer its rights and obligations in terms of these Terms to third parties.

20 - WAIWER

These Terms, including Privacy and Cookies Policy and Terms and Condition of Use, constitute the entire agreement between You and ILC S.r.l. in relation to their subject matter and supersedes any and all prior promises, representations, agreements, statements and understandings whatsoever between parties.

The failure by us to exercise or enforce any right or provision of the Terms shall not constitute a waiver of such right or provision.  

21 – GOVERNING LAW AND JURISDICTION

These Sales Terms and your purchase of Products from ILC’s website – www.bvmilano.com shall be governed by and construed in accordance with Italian laws, without resort to its conflict of law provisions. Any dispute or claim arising out of or in connection with these Sales Terms or your purchase of Products from ILC S.r.l. (including non-contractual disputes or claims) shall be subject to the non-exclusive jurisdiction of the Italian courts.

Related to it, the competent court shall be the Court of Milan.
